There is one big problem with your analogy. In this case people have spent money buying gems, only to have the game crash, through no fault of their own, and lose the energy that they paid real money to obtain. Using your example above, it's akin to someone buying a drink, then the waitress spilling said drink. In this scenario would you replace
their drink free of charge, or would you tell the customer tough luck and make them buy another?
