Official Rules: Design A Beyond the Dead Epic Boss

DESIGN A BEYOND THE DEAD “EPIC BOSS” CONTEST ("PROMOTION")

OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION.


Purchase will not improve odds of winning.

The Promotion is sponsored by GREE International, Inc. (“Sponsor” or “GREE”).

Eligibility: Promotion is open only to individuals who (a) are residents of any of the following: the 50 United States, District of Columbia, United Kingdom, Taiwan, Malaysia, Netherlands, Mexico, Canada (excluding Quebec) or Australia and (b) are at least 13 years of age. Directors, officers and employees of Sponsor and any of its respective affiliate companies, subsidiaries, agents, professional advisors, and advertising and promotional agencies, and immediate families of each, are not eligible to win any prizes.

Promotion Period: The Entry period for the Promotion starts at 12:00:00 AM (all times Pacific Time) on October 15, 2014 and ends at 11:59:59 PM on October 27, 2014 (the “Entry Deadline”). All entries must be received by the Entry Deadline to be eligible to win. The community voting period for the Promotion starts on or about October 28, 2014 and ends at 11:59:59PM on October 31, 2014 (such time period, the “Community Voting Period”).

How to Enter: Create and describe a unique in-game virtual item that could be an Epic Boss (“Epic Boss”) in GREE’s Beyond the Dead game (the “Game”). Post your description (an “Entry”) to the Game’s online forum, currently located at http://forums.gree.net/showthread.php?100332 (the “Forum”). Your Entry should contain at least the following: The name of the Epic Boss; a backstory for the Epic Boss; a description of and/or artwork for what the Epic Boss looks like; and your Profile ID. In addition, you must have an active and enabled forum account for the Game. There is a limit of three (3) Entries per individual.

Prizes: There will be ten (10) finalists and one (1) top winner. The ten finalists will be chosen by Sponsor. The Entries of the ten finalists will be posted in the Forum. During the Community Voting Period, individuals with an active and enabled forum account for the Game may vote from among the ten finalists for the top winning Entry. The Entry with the most votes will be the top winning Entry. More details and restrictions (for example, limits on the number of votes) will be if and as specified in the online forum for the Game.

(a) Each of the ten finalists will receive one thousand (1000) Gold (virtual currency) added to his or her account for the Game. The entrant with the top winning Entry will receive three thousand (3000) Gold (virtual currency) added to his or her account for the Game and the Item. The approximate retail value (“ARV”) of each finalist prize is US$10.00. The ARV of the top winner prize is US$25.00.

(b) Each prize winner will be notified via communication to his or her forum account or email on or about October 31, 2014. Odds of winning a prize depend on number of eligible entries received. All prizes will be awarded, provided that Sponsor may, in its discretion, choose not to create and implement the Epic Boss from the winning Entry in the Game, in which case the top winner will receive the 3000 Gold only. In addition, the final implementation in the Game of the Item (if done) will be done at a future date. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Limit one prize per household or address. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.

Judging Criteria: Each Entry will be judged on the following criteria: creativity and fit of an Entry within the Game. The judging will be done in Sponsor’s sole discretion. Sponsor reserves the right in its discretion to alter or reject a winning Entry, including but not limited to the top winner’s Entry. All decisions of the judges regarding this Promotion are final and binding in all respects.

Promotion Rules: In order to be eligible, your Entry must adhere to these Official Rules as well as the following:

• Your Entry must adhere to GREE’s Terms of Service, currently located at http://product.gree.net/us/en/terms/, which apply to this Promotion. Please note that the content of your Entry constitutes User Content as defined in GREE’s Terms of Service and your Entry itself is the property of GREE.

• Your Entry must adhere to the GREE Forum Code of Conduct, currently located at http://forums.gree.net/showthread.ph...ode-of-Conduct. Without limiting the foregoing, the Entry must adhere to the requirements of the GREE Forum Code of Conduct regarding: abusive and/or disrespectful content towards other players and staff; obscene, vulgar, and inappropriate text/images/links; inappropriate content based on race, ethnicity or nationality; and politics and religion or religious figures.

Without limiting GREE’s Terms of Service, your Entry must be your own original work and cannot infringe on the copyrights or other intellectual property rights of another individual, corporation or entity. The Sponsor, in its sole discretion, reserves the right to disqualify any person that it determines has violated GREE’s Terms of Service, the GREE Forum Code of Conduct, or these Official Rules, or tampered with the entry process, the integrity of the voting process, or the operation of the Sponsor’s web site. Use of bots or other automated process to enter this Promotion is prohibited and may result in disqualification at the sole discretion of the Sponsor. The Sponsor further reserves the right to cancel, terminate or modify this Promotion if it is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures or difficulties of any sort.

General Terms and Conditions: If you are under the age of 18 or such higher age of majority in your jurisdiction (a "Minor"), one of your legal guardians must submit a signed, written statement that they have read, understood and agree to these Official Rules with your Entry, and that such agreement constitutes acceptance of these Official Rules on behalf of you as a Minor and themselves. The Promotion and these Official Rules will be governed, construed and interpreted under the laws of the State of California, USA. This Promotion is subject to all applicable federal, state and municipal laws and is void where prohibited. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect. Entries become the property of Sponsor and will not be returned. Sponsor shall not be responsible for late, lost, illegible, incomplete, damaged or misdirected entries and accept no responsibility for any injury, loss or damage of any kind resulting from an entrant’s participation in this Promotion. Sponsor reserves the right to amend these Official Rules or to terminate this Promotion. These Official Rules may be changed at any time, but only by the Sponsor and only by posting new rules on the Sponsor’s web site (including the user forums). These Official Rules will not be construed to impose upon the Sponsor any obligations for any losses, debts or other obligations incurred by any Promotion participant. By entering the Promotion, you release Sponsor from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Promotion or delivery, misdelivery, acceptance, possession, use of or inability to use the prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Except where prohibited by law, entry into the Promotion constitutes permission to use entrant’s name, city of residence, likeness and/or prize information, without limitation, for Sponsor's promotional purposes without further permission or compensation. As a condition of being awarded a prize, winners may be required to confirm such permission in writing and execute and deliver a written affidavit of eligibility, acceptance of these Official Rules, release of liability, tax forms, and other reasonable documentation. By entering, entrants certify that they have complied with these Official Rules and are eligible to win.
